Problem solve this. Who's fault. Pictures only.

i think the skid mark at angle of the car may argue that somewhat. The volvo could say it saw the oncomming car and tried to avoid while breaking. the impact would have also driven the volvo out of the lane a little further. I can also see that at least one radiator was popped so that was probably a little more kinetic energy that i first imagined. Glad everyone is OK.
 
Glad everyone is ok. It's hard to tell things from pictures only. To me it looks like there is enough room to enter the turn lane, and that they are out of the lane because they were swerving to avoid you guys in the silver Toyota. However, knowing now that you guys were stationary, and she jammed the gas and effectively rammed you, ya she's a beotch!

I'm hoping progressive does something similar. My gf blew a yeild last year and totalled her car. We can't afford these mistakes.

It did take persistance. At first they didn't want to hear any thing about it, relying soley on the police report which the other driver lied on as he was drunk. I let them know I would not let this slide and handed them very detailed info to review. Many phone calls later my local rep agreed and took care of me.

things to learn .. i always thought double lines are meant not to be crossed, so they can be crossed but with caution ?

and i always do what that blue car has done when there is a seperate left signal and if cars back up with no one in the left lane i always drive past and go take the left ...Well atleast till now ..from now on i wouldnt do that ..

if the double lines can be crossed with caution then its blue cars fault for driving at that speed to make the left green and not being capable of braking properly.. and also i see white car is at mistake cause if blue car didnt go out of lane to come into that left only lane then the white car SHOULD wait till the traffic has passed and then cross the road ..

you can always get a ticket for crossing a double yellow. You're supposed to block traffic instead of doing that.

Silver Toyota is in the wrong because that vehicle failed to yield to all traffic coming from a private drive. That is not a street or intersection.

Double yellows means no passing. You can't cross solid whites.

This why I don't let people in from private drives on multiple lane roads. You might be making a nice gesture but they can't see around you for the other lanes. This is the reason you can not stop in an intersection. Just not worth it.

Without being there the skid marks look to be from a previous time. No skid marks and the amount of damage suggest a low impact speed. Herbie is also right the the vast majority of the time cars will swerve in the direction the vehicle they are trying to avoid is traveling.

+1, I wasn't sure if it was a private drive or not, but you are correct, you must yield. It happens all the time were one person is being nice waving someone through and then bam the car in the next lane doesn't stop/see the car and they get hit. Sorry it happened this way as I am sure this ladies need to be the most important person on the road caused what would otherwise have been a safe crossing. Hopefully the insurance isn't too bad.
 
Silver Toyota; as the car making the left turn, it has the burden of yielding, even if it has the right of way.

so wait a minute, does this mean that if someone pulls out in front of me from a dirveway I can just go ahead and hit them? That is both disturbing and exciting. . .
 
Herbie. Technically yeah, but you can also technically slam on your breaks to get someone to rear end you. Pro-tip: refuse to leave the car because your neck hurts really bad, regardless of actual pain or damage level.
 
I didn't start this thread thinking we were totally innocent. She failed to avoid an accident. This was low impact. The tire mark in photo is not a skid or from that Volvo. When both lanes allowed us to pass we nudged out. Of course this is very dangerous if only one lane stops and others can't see u. In this case however it was Monday @5 and trains were at it. Traffic was very heavy. Both lanes had stopped and the left turn lane was unattainable for anyone a car or two back. If she hadn't gone around vehicles to make the light it wouldn't have happened. At this point we have to pay up. Life.... He had just started to accelerate. She hit us at maybe 5-7mph. If she was speeding it would have been much worse. She simply didn't stop and the footage Walgreen has agreed to share will confirm this. I'm not tryin to take this azz whuppin. I just want a smack on the hand. ;).

Your gonna cause people to wear helmits and neck braces like a seat belt. Insurance companies run this biatch. Remember that. Outright lieing about an insurance claim is very illegal. Aka. fraud. If your caught you would be the one sued. No offense... just saying.

Too late, I've never been more offended!!! Kidding of course, when I was a kid my dad was sued by someone who claimed to slip on a piece of gravel outside of a property he managed. She asked for just the right amount of money so that the insurance company paid out and refused to fight regardless that my father was able to show that she did this very regularly and had made a career out of it. So, our rates went up and she won and went on to do it many more times I'm sure. I've learned to hate the cash in mentality and it was a sarcastic attempt. I also hate the overreactions to things like this, the screaming and hysterics when it's just a bit of car damage or delay.
 
Lol. The lady jumped outta her car screaming its on fire. The gas is leaking the gas is leaking. Clearly it was antifreeze. Lol. Her energy upset her eight year old while my 30 month and 4 month old are wanting a snack and bottle. She attempted to yell at my gf, but I stepped in cause my gf will beat yo azz if approached wrong. Lagrange police were all mad off the bat too cause the lady was acting a fool.

Both parties are at fault, but the Volvo driver broke laws. You cannot under any circumstance cross a yellow or white solid line. Imagine if a pedestrian was standing there. Lagrange is a high traffic area with allot of jay walking.
 
One more thing and ill drop this, but if you look at the Volvos front tires they are obviously not turning away from accident. Depicted in fourth photo.

Or you can bend over to pick up the pack of smokes that you dropped and then slam on your brakes and have the person rear end you. Happened to me in High School. Guy stopped in the middle of nowhere and I ended up rearending him. His girlfriend later told the story of why he stopped suddenly.

Oddly enough, same intersection same car a couple of months later, I am stopped at the light. I look up in the rear view mirror and there is a car comming at me with no intentions of stopping. The world went into slow motion, as I was able to look left and right to see if there was anywhere to go. Next thing I know, I open my eyes and I am laying in my seat fully reclined watching pieces of debris, also in slow motion falling to the ground. The guy that I hit was after me like it was my fault. Guy who hits me and turns my car into a sardine can tries to say that I stopped out of nowhere, and that his car wont go over 25, so there was no way he was going that fast. Officer surveys scene, no skid marks, and clearly one totalled car, and the one in front of it pretty much gone, had to be going over 25 at impact without hitting breaks. They take us all back to the station to clear up the whole mess. They come in and get the guy that I hit and have him remove his shoelaces and take him back to the holding cell, he was wanted on felony larceny. A friend of mine actually ended up with a ticket for not seeing traffic stopping ahead of this guy and tapping the back end of the whole mess.
